Court Refuses To Hear Binani’s Motion, Orders Her To Address Court On Jurisdiction

 The Federal High Court in Abuja, on Tuesday, declined to hear an ex-parte application the candidate of the All Progressives Congress, APC, Senator Aisha Dahiru Ahmed, filed for an order to halt further action on the ongoing governorship election in Adamawa State.






Rather, the courtin a ruling that was delivered by Justice Inyang Ekwo, ordered the counsel that appeared for the Applicant, Mr Mohammed Sheriff, to address it whether or not it has the requisite jurisdiction to entertain the matter.

Justice Ekwo thereafter adjourned the suit till April 26 for counsel to the Applicant to address the court on the issue of jurisdiction.

Even though a lawyer, Afeez Matanmi, announced his appearance for the incumbent governor of Adamawa state, Ahmadu Fintiri, he was however not allowed to address the court since the APC candidate brought the action through an ex-parte application.

Senator Aisha had in the ex-parte application marked: FHC/ABJ/CS/510/2023, applied for leave of the court to allow her to seek, “an order of prohibition and certiorari removing to this court for the purpose of being set aside the administrative decision of the 1st Respondent made on 16th April 2023 in respect of the declaration of the winner from the gubernatorial election of Adamawa State held on the 18th of March, 2023 and the supplementary election held on 15th April 2023.”

As well as, an order of the court, “preventing the 1st Respondent, its agent, assign or any person acting on its behalf from taking any further steps towards the declaration of the winner from the gubernatorial election of Adamawa State held on the 18th of March and the supplementary election held on 15th April 2023, pending the determination of the application for judicial review”.

Whereas the APC was listed as the 2nd Applicant in the suit, the Independent National Electoral Commission, INEC, Peoples Democratic Party, PDP, and its candidate/incumbent governor of the state, Fintiri, were cited as 1st to 3rd Respondents.

It will be recalled that INEC had declared that the Adamawa state governorship election was inconclusive, even as it ordered a supplementary election.

However, midway into the collation of results of the supplementary poll that was held last Saturday, the Adamawa state Resident Electoral Commissioner, REC, Hudu Yunusa-Ari, announced the APC candidate, Aisha, as the winner.

The action elicited instant reactions, with the electoral body not only voiding Yunusa-Ari’s action but equally placing him on an indefinite suspension.


In her suit, the APC candidate insisted that she was declared winner of the governorship election after the collation process was completed.

“Pursuant to the declaration of Senator Aisha Dahiru Ahmed as the winner of the gubernatorial election, any dissatisfied candidate is to resort to the tribunal for redress if any.

“The 2nd Respondent, PDP, and the 3rd Respondent Ahmadu Fintiri, who lost in the election resorted to fighting and causing a public disturbance which led to the beating and manhandling of one of the 1st Respondent staff.



“The crisis caused by the 2nd and 3rd Respondents led the 1st Respondent to announce that it had cancelled the initial declaration made by it on 16tu April 2023”.

She argued that INEC had no powers to cancel or declare a declaration which has been made as null and void.

“The only court with the power on a declaration made from the conduct of an election is only the Election Petition Tribunal set up by the 1999 Constitution of Nigeria (as amended)”, the Applicants averred.

Naira Crisis: Banks Fear Heighten As Customers Shun Cash Deposit

 The Nigerian economy has started redeeming from the three-month-long naira insufficiency, but there is another infuse risk of a possible banking sector collapse as customers shun cash deposits.




The development is a spill-over effect of the Central Bank of Nigeria’s (CBN) poorly implemented Cashless Policy, which caused Nigerians untold nightmares and hardship.

However, CBN’s massive evacuation of banknotes to commercial banks on March 24, 2023, had served as the antidote to the currency predicaments, though many Nigerians described the move as late.

But, the respite looks short-lived, following an elevated tension of banks’ insolvency amid customers declining steam to deposit cash and conduct other transactions.

New Telegraph reports that Nigerian banks’ assets rose by 10.72 trillion Naira ($22.61 billion) between August 2021 and August 2022 to hit 66.76 trillion Naira ($151.49 billion), according to CBN’s data.

Speaking with the DAILY POST, Adaeze Okolie, a resident of Abuja, said“I no longer feel the need to deposit my money with the Bank; I rather keep it. The Naira scarcity period did expose the inefficiency of Nigeria’s banking system. It was appalling, I could not withdraw for months, and online transactions were equally frustrating. Many Nigerians have learned their lessons”.

Also, Usman Abdullahi, a yam seller in Suleiman Market, said, “He would rather keep his money rather than go to the bank to deposit cash or better look for other means”.

Augustine Chukwu, a PoS operator in Utako Market in Abuja, said, “I collect cash from market men and women; I rarely visit the banking hall”.

But Abdul Imoye, the Head of Media Relations at Access Bank PLC, confirmed the decline in cash deposits by customers and said the anxiety held by Nigerians for not depositing cash would soon be a thing of the past.

According to him, what is happening now is typical of the Nigerian mentality, but business would bounce back in time.

“It is due to the ‘Nigerian mentality’; customers had struggled with cash scarcity for months, so people are normally apprehensive. But now there is cash in the banking system; I am sure things will return to normal”, he added.

Also, The CEO of SD & D Capital Management, Mr Idakolo Gbolade, said bank customers’ behavior towards cash deposits is a natural resentment.

According to Idakolo, “The bank customers will naturally shun depositing their funds, and deposit is expected to decline due to the experience of depositors in the past few months.

He also said, “Bank customers went through hell to make withdrawals from their deposits, so it is natural for resentment regarding depositing their funds back to the banks.

“This trend will continue for months before depositors adjust accordingly.

“The economy will gradually bounce back with cash infusion into the system
,” he stated.

Last Month, Nigerian Deposits Insurance Corporation, NDIC, with the primary responsibility to protect Depositors, reassured that it is committed to ensuring a solid banking system in collaboration with the CBN.

The minister urged Christians and other Nigerians to use this year’s Easter season to pray for an end to the country’s security challenges.

“Security is everybody’s business. I, therefore, urge Nigerians and foreigners resident in our country to display a high sense of citizenship and public spiritedness by supporting the efforts of all security agencies in bringing peace and security of lives and property of the citizenry,” Aregbesola said.

The minister assured that the Federal Government was taking all necessary steps to guarantee a peaceful transfer of power following the conclusion of the election process.

While wishing Christians a peaceful Easter celebration, he also urged them to love their neighbours by performing acts of kindness and showing charity, with the wealthy sharing their possessions with the less fortunate nearby.

Aregbesola reassured Nigerians that the country was on the route to greatness and urged everyone to use their creative energies constructively to fully realise the impending prosperity.
